Tree mitigation (replacement) requirements

§ 156.702(C)–(D). Removal of a protected, significant or historic tree requires replacement in caliper inches (ANSI Z60.1); inches removed are measured as DBH. On developed sites, replacement must be planted within a period not to exceed six months from permit issuance, and "if the mitigation calculation is greater than or equal to 2.5 inches, one replacement tree of at least 2.5-inch caliper must be planted on-site." On new construction, replacement trees must be installed prior to final inspection, including for accessory structures. Table 156.702-1 minimum percent replacement, Existing Residential column (good / fair / declining): Class I 50 / 50 / 25; Class II 50 / 50 / 25; Class III 50 / 25 / 0; Class IV 0 / 0 / 0. Commercial / Other / New Residential Subdivision: Class I 100 / 75 / 50; Class II 75 / 50 / 25; Class III 50 / 25 / 0; Class IV 0. Health ratings are defined in § 156.702(D)(2): Good = 100–75 percent live crown ratio, minimal structural defects; Fair = 75–50 percent; Declining = less than 50 percent. Footnote 1: for a hazard tree as determined by an ISA TRAQ Certified Arborist the replacement requirement can be further reduced or eliminated. § 156.702(C)(5): replacement is not required for removal of invasive species. FEE IN LIEU, § 156.702(M): where replacement trees cannot be accommodated on site the owner may have the option of paying into the Tree Bank Fund — "This fee shall be two times the wholesale value per 2.5-inch caliper tree required for mitigation that is not being planted on site"; the Zoning Administrator decides whether to accept the fee or require on-site planting. § 156.702(O): relocated or replaced trees are inspected one year after planting; declining trees must be replaced within 30 days of notice, with re-inspection six months later. A signed tree replacement form must be submitted before the permit is issued, and Business License verifies the tree removal company holds a valid business license before issuance.
