Golf carts on Mount Pleasant streets — SC Code § 56-2-90 (§ 56-2-105 repealed)

IMPORTANT: the statute people cite, SC Code § 56-2-105, was REPEALED by 2025 Act No. 64, § 2, effective May 22, 2025. The governing law is now § 56-2-90 (2025 Act No. 64 (H.3292), § 1, eff. 2025-05-22). § 56-2-90(A): to operate a golf cart on a public highway the owner must obtain a permit decal and registration certificate from SCDMV, providing proof of ownership, proof of liability insurance, and a five-dollar fee; the permit decal must be replaced every five years or when the owner changes address, whichever is sooner. § 56-2-90(B): the operator must be at least sixteen, hold a valid driver's licence, and carry the registration certificate, proof of liability insurance conforming to § 38-77-140, and the driver's licence. § 56-2-90(D), which applies in the absence of a local ordinance: a permitted golf cart may be operated only during daylight hours; only on a secondary highway where the speed limit is thirty-five miles per hour or less; only within four miles of the address on the registration certificate (or within four miles of a point of ingress and egress of a gated community if the address is inside one); and may cross a highway at an intersection where the speed limit is more than thirty-five miles an hour. § 56-2-90(E): every passenger under twelve must wear a fastened safety belt. § 56-2-90(C) lets a municipality by ordinance stipulate hours, methods and locations, permit night operation if the cart has working headlights and taillights, and designate separate golf cart paths on road shoulders — all still limited to roads posted 35 mph or less. SCDMV implements this with Form GC-2 (Golf Cart Permit Registration), $5, and publishes the four-mile and daylight limits. The Town of Mount Pleasant's own E-Bikes and Golf Cart page restates the state rules (SCDMV permit decal, 16+ with valid licence, carry registration/insurance/licence, secondary highways posted 35 mph or less, crossing higher-speed roads only at intersections, daylight only unless registered as a Low-Speed Vehicle, passengers under 12 belted). SOURCE CONFLICT: the Town's FAQ QID=83 still says a cart may operate "during daylight hours only within two miles of their residence." Two miles is not the current law; § 56-2-90(D)(3) and SCDMV both say four miles. Verified 2026-09-04.
