Dog and animal ordinance — Mount Pleasant Code Chapter 90

Chapter 90 ("Animals") governs dogs. § 90.01 defines CONTROL or UNDER RESTRAINT: an animal is under control or restraint if it is on the premises of its owner or keeper, or is accompanied by its owner or keeper and under that person's physical control "by means of a leash not more than eight feet in length or other similar restraining device," or is under the active control of the owner or trainer while hunting or being trained. DOG is defined as any member of the canine family six months or more in age. § 90.29 (Nuisance Animals, '81 Code § 90.15; Ord. 93050, passed 1993-10-12) makes it unlawful to keep an animal so as to constitute a public nuisance, and lists eight examples: allowing an animal to run without control or not under constraint; allowing damage to another's property; maintaining an animal that habitually chases, snaps at, bites or attacks pedestrians, bicycles, vehicles or other animals; allowing an animal to "bark, whine, howl, honk, bray, cry, or make other noises in an excessive, continuous, untimely, or unreasonable fashion"; noxious or offensive odours; defecation on any public place or premises not owned or controlled by the owner unless promptly removed (defined as two minutes); unsanitary conditions producing odours, filth, vermin or disease; and maintaining property offensively or dangerously because of the number, type, variety, density or location of animals on it. § 90.30 prohibits keeping dangerous or vicious animals, with a determination by the Animal Control Officer appealable in writing to the Town Administrator within five working days and a hearing before the Town Administrator or designee.
